Super Bowl LIFour NFL teams got one step closer to the Super Bowl LI this past weekend. The New England Patriots, Pittsburgh Steelers, Atlanta Falcons, and Green Bay Packers are all still in it to win it. Wix.com is airing a Super Bowl commercial for the third year in a row! They made history by launching their 2017 Super Bowl ad campaign on Facebook Live on January 17. This is the first time a brand ever released an ad using Facebook or YouTube Live. The action-packed ad features duo Gal Gadot and Jason Statham, with a nice guy named Felix playing the hero (and website builder).

In addition to the ad, Wix also announced the WE ARE ALL LIKE FELIX GIVEAWAY offering a chance to win up to $50K. First you have to Felixdownload this photo of Felix and then make it your Facebook Profile photo. Once that is done you fill out an entry form that includes your Facebook account URL. The Giveaway will award 11 winners, 1 winner for each “Shuffle” period, which the first one starts of Jan. 22 and ends on Jan. 23. Each Shuffle period winner will receive $10,000. The “Game Day” Shuffle will take place on Feb. 5 and that winner will receive $50,000. So Wix is awarding $150K total. That’s a nice prize pool!

Mars, which is the parent company of both Skittles and Snickers, has kicked off a pre-Super Bowl promotion called “The Candy Bowl” Game and Sweepstakes. They are asking people to choose whether they’re on Team Snickers or Team Skittles. People can participate by sending a text message using several different keywords or by texting a photo of one of their specific brands. They will receive a text message back telling them whether they are a winner in the game or to try again. People can also visit candybowl.mars.com and select either the TEAM SNICKERS or TEAM SKITTLES button to play the game to see if they are a winner. SnickersEach time someone plays the game they also get an entry into the sweepstakes.

The sweepstakes grand prize will include a pair of tickets to a 2017 season home game of an NFL team of the winner’s choice. The game includes 500 first prizes of t-shirts and 25,000 second prizes of coupons for select Mars candy products. Total prize pool is $94,500.

Mars is also running several TV spots during the Super Bowl. Skittles will be back for the third year in a row. However, Steven Tyler won’t be back. Instead Skittles will focus on the “Taste the Rainbow” tagline without enlisting help from any celebrities. Mars will also be promoting Snickers with a new Super Bowl ad that will star Adam Driver of Star Wars. They will be sticking to their “You’re Not You When You’re Hungry” theme.

Super Bowl LIWe’re already into our second week of January, so I’m now going to focus on the NFL playoff season and the Super Bowl, which has been my blogging tradition. I will be covering some of the ads and promotional campaigns associated with Super Bowl LI which will be hosted on February 5, in the NRG Stadium in Houston. This year it’s Fox’s turn to broadcast the game and reportedly they’re charging between $5 million to $5.5 million for a 30 second ad slot, which is more expensive again.

Here’s what the playoff picture looks like:

NFL playoffsMost bets are on the New England Patriots to win the championship this year. But who will play with them from the NFC is still a toss up. Some are betting on the Packers, others the Falcons, but many would like to see the Cowboys make it there. We’ll see who’s still in it after this weekend.

Pepsi is again the sponsor of the Super Bowl LI Halftime Show. The Pepsi Zero Sugar Super Bowl LI Halftime Show will include Lady Gaga this year. She belted out the National Anthem at Super Bowl 50 last February which really impressed both her fans and her critics.

Doritos, which is part of PepsiCo, ended their 10 year long run of its Crash The Super Bowl Contest which I’ve been covering here for many years. Back in 2006 when it began, the contest invited consumers for the first time to create and submit 30-second homemade ads to promote the Doritos brand. It appears that this year Doritos will be taking a year off and not be running any ads during Super Bowl LI, although the parent company is promoting some of its other brands.

TostitosPepsi and Tostitos have parented up this year with a big NFL promotion that gives fans the chance to win unreal NFL Experiences. This started back in August and the chance to win the last of 17 different sweepstakes just ended. Fans were invited to submit codes found on specially-marked packages of TOSTITOS chips and dip products and PEPSI 12oz 12 packs for entries. They could also use these codes to collect points good towards NFL Team Merchandise. A few of the sweepstakes included Super Bowl LI Experiences that each awarded 2 fans a trip to Super Bowl LI along with attending team warm ups from the sidelines and exclusive access to return to the field for the post-game trophy presentation with the Super Bowl Champs. Other experiences awarded included a Drew Brees Experience to meet the quarterback in New Orleans, an International Experience to attend the pre-season game at Wembley Stadium in London from 50-yard line seats and the last sweepstakes, the 2017 NFL Kickoff Experience, which includes two tickets to the attend that game, as well as the first Sunday night game of the season. Bud Light Golden CanAnother big NFL sponsor is also awarding tickets to the Super Bowl. The Bud Light Super Bowl Tickets for Life Sweepstakes is giving a chance to attend the game not just once, but every year for the next 51 years. The yearly prize includes a pair of Super Bowl tickets plus $1,000 in cash and is worth about $166,000. Participants have to look for a Bud Light Super Bowl LI Gold Can inside specially marked packages of Bud Light or they could visit the promotional website to obtain a Bud Light Gold Super Bowl LI Can Wrap to wrap around any can or glass. Then they need to take a photo of themselves with the can and upload it to either the Bud Light website, post it on the Bud Light Facebook page as a comment in response to the sweepstakes post or post on Twitter or on Instagram all using the hashtags #SBTix4Life and #Sweeps. This sweepstakes is closing soon, 1/13, and the grand prize drawing will be held on 1/16.

The Super Bowl has been one of the most watched sporting events and continues to have much advertising and marketing associated with it. CBS’s broadcast of last year’s Broncos, Panthers Super Bowl game came close, but couldn’t top Super Bowl XLIX which was the most watched program in American television history. So we’ll see if we break that record this year. Stay tuned for more coverage as the road to the Super Bowl continues.

The social giant hosted their annual conference for developers known as F8 back in April. Here they rolled out more updates for their Messenger platform and launched a few bots on the platform as well. Facebook Messenger continued to roll out more updates as the year went on copying many of SnapChat’s features. Facebook ended the year struggling to deal with fake news on it’s platform which will continue to be an issue into 2017.

So I wrote a post on a Father’s Day promotion the week before and the week before that I wrote about a Twitter promotion for grads. So this post was focused on brides. A.C. Moore Arts & Crafts launched  a chance to win a wedding with their Craft Me a Crystal Coast Wedding Contest. The grand prize wedding consisted of a trip for the bride and groom to the Crystal Coast, North Carolina, to get married on October 22, 2016.

This was probably the biggest promotion that we worked on in 2016 and the one that has received the most comments from our post back in July. In fact I just received another one today asking about the winners. While we don’t have any part of the judging of this contest, the period for the judges to review all the submissions was till December 30, 2016. So we expect that they will announce the finalists on their web page very soon. So we’ll be watching for the announcement.

TideRaising an Olympian: Simone Biles and the Final Five at the Rio 2016 Olympic Games

I wrote a few posts back in August covering the Summer 2016 Olympic Games in Rio. This surely was one of the greatest highlights of the year in sports for the USA. Simone Biles and Aly Raisman picked up the gold and silver medals respectively in the Women’s Floor final. Then the Final Five went on to win gymnastics team gold. Procter & Gamble’s “Thank You, Mom” ad campaign was back, featuring real Olympic athletes and their moms. Part of this campaign featured the “Raising an Olympian: Simone Biles – Rio 2016 Olympic Games” ad. P&G was smart enough to realize at the time that Simone was going to be a new star. Orioles HandoutTonight’s the final game for the Dream Fan Experience Sweepstakes at Camden Yards

This was one of the last games of the regular season for MLB, with my team, the Boston Red Sox playing against the Baltimore Orioles. They ended up beating the Orioles for their sixth straight victory. They would go on to the post season only to get swept by the Cleveland Indians were we got to see David Ortiz’s (Big Papi) career come to an end. I was so glad that I made a trip to Toronto that season to see him play with the Red Sox against the Toronto Blue Jays. I had hoped to see a World Series with the Red Sox and the Chicago Cubs, which didn’t happen. But the Cubs and their fans were finally awarded their first World Series title in 108 years!

Marketing Law ConferenceHighlights from the 2016 BAA Marketing Law Conference in Chicago

I headed back to Chicago in November to attend the BAA’s 2016 38th Annual Marketing Law Conference. The BAA had another great year with over 750 professionals in attendance ranging from regulators, legislators, corporate counsel, marketers and technology innovators who gathered again at the Marriott Hotel on Michigan Ave. This is a great conference to keep up to date with the latest on regulations and rules in our industry. This year’s conference began the day after the election. So there were many discussions going on during the breaks and cocktail receptions about it. It will be an interesting 2017 to see what will now change.

Her Great Home GiveawayWinner awarded $250,000 in the Great Home Giveaway during Ohio State Football Game

This sweepstakes we saw are largest prize to date awarded which happened during one of the intermissions of this football game between Ohio State and Michigan. Congratulations went to Kathy Lowery from Columbus. She got to choose between the following options: 1) A $250,000 Trinity Home in an existing Trinity Home subdivision; 2) A $165,000 credit towards building a Trinity Home in a Trinity Home subdivision throughout Central Ohio; 3) $100,000 cash option. Last we heard Kathy choose to take the $250,000 home. The Ohio State Buckeyes ended up defeating the Michigan Wolverines 30 to 27 in double overtime in what was reported to be the most exciting college football game of the season!

HCC Dream Vacation ContestWe’ve been working on this new holiday Pinterest contest that is awarding four $250 certificates to Hotels.com., one per week. The Dream Holiday Contest from the folks at Tokio Marine HCC – Medical Insurance Group. I wrote about an earlier promotion this same group ran back in October called the The “Choose Your Travel Adventure” Sweepstakes which offered the winner their choice of three different destinations, Reykjavik, Sydney or Florence. Haven’t heard yet what destination the winner is going to.

For this new contest, participants are invited to create a board titled “Holiday Travel with Tokio Marine HCC – MIS Group”. The Board should contain at least 10 pins to the theme of “My International Holiday Travel Dream Vacation”. At least 3 of these pins must come from the Sponsor’s website, and they recommend their travel blog which provides the most relevant content. Each pin must include the hashtag: #DreamHolidayContest. Here’s a sample board that the sponsor created.

boardOnce their board is complete, each participant must go back to the Sponsor’s promotion webpage,, where they will need to fill out and submit all the required fields on the entry form along with a link to their Holiday Travel Pinterest board. They must also answer the following questions: 1) Are you planning to travel internationally in the next 12 months? If yes, then enter the trip’s start date. 2) What are you most excited about this holiday season?

The contest started Nov. 28 and goes to Dec. 21, 2016, so there were four chances to create a winning board, with two of them still left. At the end of each week the judges are using the following judging criteria to review the boards: 1) Overall board theme 2) Variety of pins 3) Variety of sources 4) Striking imagery 5) Number of board followers.

stitch-fix-coverStitch Fix contacted us regarding running a sweepstakes this stitch-fix-styleDecember and I had never heard of them. I didn’t understand what a “fix” was so they had to described it to me to help me understand how this promotion would work. So I checked out their website www.stitchfix.com and was pretty intrigued by the whole concept.

Now I’m not what they call a “fashionista”, but I do like to look stylish while being comfortable. I had just went through my closets and cleaned out so many clothes that I haven’t worn in years. So my wardrobe definitely was in need of some updating.

How Stitch Fix works is you create an account to start and then go through a series of questions to help your “personal stylist” get to know you a little, what your style, size and price preferences are. Once that is done you request a “fix” which is five hand-selected pieces of clothing delivered to. You buy what you like in your fix and can send any items back at no charge or shipping fees.

stitch-fix-dressSo I thought I’d give it a try but not sure if I would keep any of the items. I did tell my stylist that I had a wedding coming up in December that I would be attending. Sure enough, there was a knit lace dress in my fix. It probably would not of been an item that I would have picked myself, but I tried it on and love it.

My fix also included some drop earrings to go with the dress, a navy pullover sweater, a winter white cardigan and a printed blouse. The fix comes with a personal note from your stylist, in my case it was Shannon, describing the items she picked for me. Plus a print out of each item shown with other items that would go nicely with them.

I ended up keeping all five items and have been happy with them all so far. The wedding is this Saturday, so I’ll see if people comment on my dress. If you keep all five items you get a 25% discount off the total prize. They will send out a new fix every other month, but you can cancel at any time or ask for the delivery time to be changed. So I’ll see how I like the next fix is in January.

For each fix that a person requests they will automatically receive one entry into the Sweepstakes and one Instant Win Game Card will be sent to them with their fix. The game cards include a scratch off area that reveals if it is a winning card of a $50 Stitch Fix gift certificate. There are 725 gift certificates that can be won. We had to include a method of entry without purchase, so people can also mail in a request to receive a game card and a sweepstakes entry.

her-realtors-home-giveawayA couple of sponsors of Ohio State University’s football team, HER Realtors in Ohio and a home building company in Columbus, Trinity Homes, recently partnered on a big promotion.  We worked with them to administered the Great Home Giveaway which offered a chance to win a new home worth up to $250,000. The promotion originally launched on September 3 and concluded this past Saturday, November 26, during the OSU’s football game with Michigan in Columbus, Ohio.

Here’s how it worked. The sweepstakes was only open to residents of Ohio who were invited to visit a promotional page on the HER Realtors website and complete a registration form. They then had to visit a Trinity Homes model home site in Ohio and validate their entry with a Trinity Homes representative by October 29. There was a mail-in option available to receive an entry as well.

Each of these three winners won two tickets to the OSU vs. Michigan Football Game on November 26 were they would get to participate for a chance to win the Grand Prize in a Lucky Key Game.

At one of the intermission times during the game, the three winners came out on to the field, along with the representatives of the sponsors, to  play the game. They were each given the opportunity to select one of three keys to try and unlock the door to determine who would win the grand prize. We conducted a random drawing prior to the event to determine the key selection number for each winner. The first winner tried to open the door unsuccessfully. The second winner then took their turn and was also unsuccessful. It was the third winner who’s key opened the door.

In fact on Friday we broke a record and hit 72 degrees. But on Saturday afternoon the winds picked up and the temperature starting plummeting. By Monday morning we were looking at our first major snow fall, more than 14 inches in the city which caused most schools to be closed and some traffic delays.  I can now say that yes, it’s beginning to look a lot like Christmas.

marketing-law-conference-20We attended the BAA’s 2016 38th Annual Marketing Law Conference which wrapped up last week on Friday, Nov 11th. The organization (Brand Activation Association) had another great year in  attendance with over 750 professionals ranging from leading regulators, legislators, corporate counsel, marketers and technology innovators who gathered again at the Marriott Hotel on Michigan Ave. This year’s conference was entitled “FACE-OFF: Dynamic Technologies Vs. Regulatory Controls.

ed-kubak-2016“Ours is an industry of rapid evolution” stated Ed Kabak, SVP, ANA and Chief Legal Officer, BAA who kicked off the first official day of the conference. “Since we deal with best practices and the state of the art in Marketing and Advertising Law and Digital Media; IP and Privacy, FTC, State A.G. and state-regulation, Lanham Act, Class Actions, and other areas, this forum is invaluable for marketers to move responsibly forward.”

The conference started off with a day of pre-conference sessions dedicated to basics as well as advanced subjects. I arrived in Chicago that day in time to attend the “Advanced Social Media Sweepstakes/Skill Contests/The Major Platforms and Pitfalls session. This included a nice review of the major platform promotional guidelines including Facebook, Twitter, Instagram, Pinterest and Snapchat. One case study reviewed was the “Drive a Tank” Sweepstakes where a gaming sponsor awarded a grand prize that allowed the winner to actually drive a tank on top of two cars. There were 1.8 million entries from 40,000 entrants who were awarded extra entries from sharing on Facebook and Twitter. There were several issues, such as they didn’t disclose with a proper hashtag to comply with the FTC’s endorsement guidelines and they had to take out additional liability insurance to allow for someone to actually drive this tank.

As has been the case in past years, once the conference officially opened we heard from Linda Goldstein, a Partner and Head of the Advertising, Marketing and Media practice at Manatt, Phelps & Phillips LLP in New York who delivered her annual industry review. Linda reviewed some of the most newsworthy developments of the year and what they mean for marketing and advertising lawyers and professionals. Linda’s talk is always very informative and entertaining as she reviewed again the basics of sweepstakes and skill contests along with social and digital media legal issues from some of the latest promotions.

linda-goldsteinLinda noted that Scavenger Hunts are making a comeback and questioned if these type of promotions pose a time consideration. Delta Airlines ran a Snapchat promotion where participants had to look for filters throughout the LA area. How much time is too much? The Supreme Court did state in a prior ruling that a half an hour is okay. She recommended that you use your gut and impose limits if you feel uncomfortable about the risk.

As far as consideration in mobile promotions, data charges may apply if having to use only a mobile app. Text messages should still have an AMOE and you should disclose that text messaging charges may apply. However, if downloading a free app, there is no consideration, however if the app is a free trial and the participate has to actually cancel to avoid future charges that could be troubling.

Linda entertained us throughout her talk with videos of a new, imaginary app her team created called PizzaMon Go! It included real robots who would come to you and make you a artisan, personal pizza with your choice of toppings. Several issues arose as these young entrepreneurs launched this new technology including privacy issues, in-app purchase requirements, weather related issues that impacted events, and more. In the end, one of the robots was designated as our next Supreme Court Justice.

On Friday morning we were treated to another highly entertaining presentation from Ron Urbach, Chairman/Davis & Gilbert LLP, who also demonstrated how important it is for those in our industry to keep current. His presentation was on the interplay of marketing and advertising law to activate brands. Ron stated that every day attorneys make risk decisions when advising clients so it would probably be helpful for them to know what is on the regulators’ minds. We get asked the question quite often, what are the risks involved? Ron reminded us that Attorney Generals are political animals who will track publicity; that the “reasonable person” standard invoked by the FTC may not be what is considered reasonable at the state level; and that consumer complaints can drive AG actions.

Some recent examples Ron gave was that the FTC charged Lord & Taylor that it deceived consumers through paid articles and paid Instagram posts from the online publication Nylon that came from 50 “Fashion Influencers” promoting a certain dress. Warner Brothers Home Entertainment paid certain gaming influencers, such as PewDiePie, to post positive comments about the Shadow of Modor Game. The Kardashians have been charged that they did not disclose their relationship to the brands that they hype of Instagram.

ron-urbach-regulators-videoRon did emphasize that promotion is one way for a brand to develop trust with consumers. So it’s always best to be transparent. One thing that I have always heard since the early days of social media. The promotional terms for sweepstakes and contests are a contract with the brand and the consumer. So he advised not to use last year’s terms and to learn from the lessons of the last year. Be consistent with what you say to the consumers, in your ads, through your social influencers, entry materials and POS. Ron ended his talk with a video that asked people on the street “If you were a hashtag, what would you be?” Ron’s was #WhatIDoForClients. chicago-2016This year’s conference did start off the day after the election. So there was quite a bit of discussion about it during the breaks and cocktail receptions. It was noted that Donald Trump has spoken out against the new privacy rules the FCC has imposed along with some changes to the advertising tax laws that are on the table.  So 2017 looks to be the busiest congressional year yet. taco-bellTaco Bell is giving out free tacos today! A free Doritos Locos Taco per person will be offered at participating Taco Bell locations nationwide from 2pm to 6pm. It’s all part of their “Steal a Base, Steal a Taco” campaign that they have been running once again during the World Series. You can thank Cleveland Indians shortstop Francisco Lindor, who stole a base in the first inning of Game 1 last Tuesday night.

world-series-2016Now tonight all eyes are will be on Game 7. Last night, the Chicago Cubs tied up the World Series by beating the Cleveland Indians in Game 6. They won 9-3.The Cubs haven’t won the series since 1908. The Indians haven’t won since 1948. That’s 108 years versus 68 years. So there is a lot on the line tonight. One long-suffering fan base will finally be rejoicing. For the other, it will be another year in an endless string of broken hearts. I have to admit I’m cheering for the Cubs. I was at Wrigley Field this summer and it is an iconic stadium.

taco-bell-doritos-locos-tacoThe Taco Bell “Steal a Base, Steal a Taco”promotion has been running for several years now.  The deal is if a base is stolen by any player for either team during any game of the 2016 World Series championship, Taco Bell will offer every person in the U.S. the opportunity to obtain one (1) free Doritos® Locos Taco valued at $1.49 each. So if a player steals a base tonight, the free taco will again be offered on Thursday, Nov. 10. Taco Bell will make an announcement to confirm this. Last year Lorenzo Lamar Cain a center fielder for the Kansas City Royals stole a base and free tacos were given out.

So can the Chicago Cubs come out with a win after being down one game to three and end the curse? We’ll find out tonight!
