Our Sweepstakes and Contest Administrative Services package includes the following:

Legal advice and counsel

Render general advice and assistance during the conceptual development phase of the Promotion, particularly as related to legal issues and the sweepstakes or contest mechanics.

Creative Review

Review all advertising and/or promotional copy you wish to submit for its maximum effectiveness and/or technical accuracy

Writing of Official Rules

Submit to you our draft of Official Rules (and disclaimers, as needed) that will govern the offer, based upon supplied prize structure and values, or review/edit your supplied rules

Procuring of surety bonds and State registrations/filings

For sweepstakes if your total prize pool is in excess of $5,000 in total value, then it needs to be registered and bonded in the states of Florida and New York. If you have retail locations in the state of Rhode Island, then you need to register and bond this if the prize is just $500 or more. If you want to include Canada then you need to be aware that the providence of Quebec is very strict and requires bonding and registration for sweepstakes along with all communications to be produced in both English and French-Canadian.

Providing PO boxes/”Mail-to” addresses

This may be needed if an AMOE (alternate means of entry without purchase) is included in the rules.

Winner selection/confirmation

Draw winners from all those that entered during the promotional period(s):  weekly, daily, monthly and at the end of the promotion.

Procuring Affidavits of Eligibility and Publicity/Liability Releases

Verify eligibility of Grand Prize winner to assure their compliance with Official Rules via a written “Affidavit of Eligibility and Liability/Publicity Release”.  We will also obtain affidavits from the secondary prize winners if the prizes are $600 or over in value and upon request.

Winner’s Lists

Provide address for requests for Winners List and fulfill copies via return mail (including postage) to any individuals and/or state gaming departments that request them.

1099 Forms

Submit IRS 1099 forms for all prizes we fulfill in excess of $600.

Indemnification

American Sweepstakes carries $1,000,000 of Errors & Omissions insurance policy in order to offer indemnification as part of our legal and administrative package.

Facebook Promotional Guidelines Compliance

American Sweepstakes is fully aware and up-to-date on all Facebook rules and regulations for running sweepstakes and promotion on their platform. We will guide you in the development of the application and include the necessary terminalogy in the Official Rules in order to meet their criteria.
